Terms of Use for Echo

These Terms of Use (“Terms”) govern your use of the Echo mobile application (the “App”) and related services operated by Echo (“Echo”, “we”, “us”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What Echo is

Echo is a location-based application built for the Solana Seeker device. It lets users discover, create, and claim location-bound content and token rewards (“Echos”) recorded on the Solana blockchain. Access to certain features requires holding a Seeker Genesis Token (SGT).

2. Eligibility

You must be at least 18 years old and legally able to enter into these Terms. Because the App involves digital token rewards, it is intended for adults only. You are responsible for ensuring that your use of the App is lawful where you are located.

3. Wallets, blockchain, and tokens

The App interacts with the Solana blockchain. You are solely responsible for your wallet, private keys, and seed phrase. We never have access to them and cannot recover them. All blockchain transactions are final, irreversible, and publicly recorded.

Token rewards (including SKR) distributed through Echos have no guaranteed monetary value. Digital assets are volatile and may lose value. Nothing in the App is financial, investment, legal, or tax advice. You are responsible for any taxes arising from your use.

4. Location-based use and safety

Echo requires location access to function. Use common sense and stay safe. Always obey local laws, traffic rules, and private property rights when traveling to an Echo. Do not trespass, endanger yourself or others, or use the App while driving or in unsafe conditions. You use the App and travel to locations entirely at your own risk.

5. User content

If you create an Echo or upload content, you are responsible for it. You must not upload content that is illegal, infringing, hateful, harassing, sexually explicit, deceptive, or that violates anyone’s rights. Content you publish may be stored on public decentralized storage and the blockchain and may be permanent and publicly visible. We may remove or disable access to content where technically possible, but cannot delete on-chain data. You grant us a non-exclusive, worldwide license to host and display the content you submit, solely to operate the App.

6. Acceptable use

You agree not to: exploit, attack, or attempt to manipulate the smart contracts, faucet, rewards, or gating mechanisms; spoof, falsify, or manipulate your location to claim Echos; use bots, scrapers, or automated means to abuse the service; reverse engineer the App except where permitted by law; use the App for any unlawful purpose.

7. No warranty

The App is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, secure, or that Echos or rewards will always be available. The App is provided as an experimental, beta-stage product.

8. Limitation of liability

To the maximum extent permitted by law, Echo and its contributors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of tokens, data, profits, or value, arising from your use of the App, blockchain transactions, smart-contract behavior, third-party services, or travel to physical locations.

9. Third-party services

The App relies on third-party services (including the Solana network, RPC providers, IPFS/Pinata storage, and map providers). We are not responsible for their availability, performance, or terms.

10. Changes and termination

We may modify the App or these Terms at any time. Material changes are reflected by updating the “Last updated” date. We may suspend or discontinue the App, in whole or in part, at any time.

11. Governing context

These Terms are intended to be interpreted in a manner consistent with applicable law in your jurisdiction. If any provision is unenforceable, the remaining provisions remain in effect.
